Re: Denied IEP but they gave my son a 504???? Help...

I would avoid the 504 and demand an IEP. Don't sign off on it if you haven't

already done so. You lose some rights. Asperger's qualifies him for an IEP.

If they want to maintain that he is high functioning enough that he deserves

almost no services, then they can do that, but he should still have an IEP.

Also, if he has any problems 1-2 years down the road, changing his IEP would be

relatively easy.

WHERE in Virginia are you? What county? Get in touch with local support

groups.

With a 504 Plan you can have accommodations for him, make modifications needed.

If there are services like speech or occupational therapy he needs, an IEP is

needed for those (just an example). Any services like that that fall under

" special education " would need an IEP.

My AS son also has OCD and a dysgraphia diagnosis and we had a 504 Plan for him.

His OCD and dysgraphia were our primary problems at that time. We had things in

it like: no time limit on tests; could turn in work late without a grade

penalty; could take unfinished classwork home to finish (as opposed to having to

turn it in that day); some assignments he didn't have to write complete

sentences for answers, could write short answers. We could have had shortened

assignments for him (less chapter questions or less math problems) and we put

that in there, but he wouldn't use it, wanted to do whole assignments like rest

of class. What else? Oh, teacher notes in some things since it was hard for

him to keep up with taking notes in class, getting them all down. One teacher

even gave him copies of the weekly definitions, so he wouldn't have to look up

words and define them (saved him the writing, plus his OCD interfered with

reading). And since writing was such a problem for him for a while, I was

allowed to have him dicate his homework to me to get it done (this was in middle

school, he was past the " learning how to write " age).

We had a 504 for awhile (Kinder to 5th maybe?) and eventually it turned over to an IEP. I think it depends upon what they are willing to provide for him via the 504. I would listen first to what they are offering and if it doesn't fit his needs, then I'd speak up. We expected to go from the 504 to an IEP after our son gained the Aspergers

diagnosis and 3 learning disabilities. When he got his first 504, he was only

diagnosed with ADD.

Each situation is different, but we were able to get each or our DS's needs

addressed in the 504. So far, the school is complying and my DS is getting the

help he needs. Before we agreed, we grilled everyone at the meeting on the

alternatives available to address his various needs. Most of the group was

forthcoming.

Another bonus for us is that the IEP would have put him with the one member of

the team who was hostile to our request for his math support. The support he's

receiving under the 504 seems to be enough so far and he's staying with his

primary teacher, who has been very helpful.

And agreement to a 504 doesn't mean that you can't try again for an IEP if

things don't work. Our DS hits middle school next year, and we'll be looking at

it again.
