You need to create a timeline of events that occurred. Start out with a rough draft and add to it as you recall and get more info. Use exact times and names and titles. Do you have anything about CPI on your son's IEP? Crisis Prevention Intervention? It allows the school to restrain your child but it has guidelines that the person must be trained to utilize the method as well as knowing that it's a last resort method.  You need to get down all the information that the teachers told you about the event and use this in your timeline.

Read this article. You have a lawsuit on your hands but you need to be informed by getting all the information about what happened on that day. THIS IS A MUST!!

Here are some details about what has been happening.

1. There is an IEP, and BIP - I have been working on getting each one of these changed and I have had an IEE granted on the FBA. The school did an FBA back in Jan 2010, out come of School dist FBA we do not know what causes the behaviors and the behavior are unpredictable, this is why I asked for an IEE on the FBA. The person who is to do the IEE FBA had a difficult time accessing an observation at the end of the school yr. She has had issues getting into the school this year to observe my child not sure why at this point.

2. I have meet with the school resource officer on many occasions to discuss what I have done as a parent in the school and school dist. In order to get a differnt placement, IEP, BIP etc. As well as informed the officer of my child's Sensory processing disorder and how he can become sensory defensive.

3. The school has not tried to change the current BIP or call any meetings on what is not working for my child at this time. I Have asked for meetings to review current IEP Did you request these meetings in writing? and etc, on the joke of the BIP in place it is stated that: use of non-violent CPI methods to block and or will escort student to the office (using non violent CPI) and or will call for an administrator or SRO for assistance. The school or district administrator will determine the appropriate disciplinary course of action based on the severity of the aggression and will contact the parent with the decision. MY son was lying on the floor in the fetal position. I had just taught my child this coping skill this last week, we call it turtle mode, to just lay on the floor in either the fetal position or hide like a turtle in his shell, to cover his ears and try to take some deep breaths to calm himself. That if he was on the floor, not bothering or grabbing at people he would be safe and no one could hurt him.

I guess what I am hoping for is to hear what others have done in this type of situation as well as how does the process work when charging a person, do we get a ticket or some sort of paper work showing this, as of today have not received. Thank I look forward to hearing from members. You need to request a copy--full and complete--of your son's education records.Have you ever done a FERPA request? If not,  I will send you a draft letter that you merely have to insert your information into, but you must do this if you are serious.  This request will require the school to give you all records that the school maintains on your son. Granted, the liars that schools are, they will hide documents, but it makes it harder for them to use them in court against you if they suddenly pull them out for a judge to see. kwim??

3 years ago this is the same thing that happened to us.

You will be getting a letter in the mail from the police department and it will have the instructions on what to do.

Here is what I did:

1. Documented all the statements thus far.....Resource Officer, teacher, my son, etc....this included before, during and after incident

2. I got his primary doctor to write a 1 page summary letter of all his diagnoses and also got his other psych testing papers together and brought them to the juvenile intake meeting.

3. I call for an immediate IEP meeting......IEP and BIP were not being followed....(this is where I changed placement - see item #3). He was not going back - SAFETY was number #1 and I was serious about it.

4. I toured all the private schools as well as the public schools that serviced children like my son.....Aspie with food allergies and ADHD

Documentation is key - from the injures your son has to the statements of all involved parties......also call your local Special Needs lawyer and see if they happen to be taking cases for free - I have used an attorney 1 time like this.......amazing what cases they will take on. Or call the local University to see if Law Students need some experience.

I did call an ambulance when I was at the school, my 18 yr old went with me, when I arrived my 13yr old was in a panic of sorts, I was kicked out of the SRO's office because I asked him to lower his voice as he was to loud, that my son could not handle all the sensory going on around him and then add a loud voice to it. I walked out of the SRO's office my 13yr old started to have trouble with his breathing, at that point I was not sure if it was a panic attack or if he was injured during this SRO restraining him, I asked the police officers about 3 of them who where standing by the same office to please call an ambulance no complied with my request and ignored me, I then handed my 18yr old my cell phone and asked him to call 911 and he did. My son was transported to the hospital, then released to me at the hospital. I took him to his PED doc yesterday do to him complaining of his eye, the PED doc did document and measure all the bruises along with his eye injury to the cornea. I did take pictures at the ER with my 18yrs cell phone and then right when we got home with the digital camera.

Oh, and before I left the house I grabbed my voice recorder and had my 18yr old put it in his pocket so I could record what was going on, it a lil hard to hear, I am able to download to my PC maybe somehow I can clean up the sound or ask someone I know good with this technology help clean up the back ground noise.

Do you have anything about CPI on your son's IEP? Crisis Prevention Intervention? There is nothing in his IEP on CPI, I have put a letter I had written on no restraint and no seclusion in his school file and the district has a copy. I do not think the Sp. Ed teacher or the Asst. Principal is trained in this at all.

You need to get down all the information that the teachers told you about the event and use this in your timeline. Ok, but teacher would not talk with me she stayed back and away from the commotion. The only people who spoke with me where the SRO, other police officers and briefly the asst principal, she had just made the phone call to me at home that I needed to come to the school that my son was having issues and he might be arrested. Will document this all tonight.

Yes, I did request these meetings, I sent them by email to the teacher, both principals and the sp. ed directors at the school dist. building. I have copies of these emails saved.

I asked for a copy of his educational records just this last April, but the request was for only the last 2yrs, 5th and 6th grade, there are copies of IEPs from the lower grades but I do not think that the note book I was given is complete. OMG..I am crying ...crying for you and your son. How horrible...what misunderstanding. Shame on the school. Why didn't they call you! OmG...OMG. And, to think this could happen to any and all of our children. I am praying for you.

The school did not handle this situation well at all. Why did they call the SRO? Didn't they know about your son? I can't believe it! My mouth is wide open...and shame on that school...shame! I truly think you have a case against them.

I think I am going to make adjustments to my son's IEP...just because of this. My son has never been in such a situation ...but it could happen. We all need to be alerted of this and change our IEP's to protect our children. Obviously the school doesn't understand children with Asperger's and Sensory Integration problems. Get yourself a Good Lawyer!

I work as a para in a school and we are all required to be certified in CPI. In fact, I have to take my refresher course next week. The teacher should have called the asst. principal or principal and then had someone take her class out of the room and left your son there with a adult. They should have called you and waited for you to come. Calling the SRO only made the situation worse. If they had taken the children out of the room and let your son calm down...it would have ended differently. All they needed to do is let him calm down and moved any objects out of his way so he would not get hurt.

I am praying for you and your son! Will your son talk about what went on before his meltdown? Good thing you had your other son with you and your cell phone and voice recorder. Great thinking on your part.

dist. In order to get a differnt placement, IEP, BIP etc. As well as informed the officer of my child's Sensory processing disorder and how he can become sensory defensive. 3. The school has not tried to change the current BIP or call any meetings on what is not working for my child at this time. I Have asked for meetings to review current IEP and etc, on the joke of the BIP in place it is stated that: use of non-violent CPI methods to block and or will escort student to the office (using non violent CPI) and or will call for an administrator or SRO for assistance. The school or district administrator will determine the appropriate disciplinary course of action based on the severity of the aggression and will contact the parent with the decision. MY son was lying on the floor in the fetal position. I had just taught my child this coping skill this last week, we call it turtle mode, to just lay on the floor in either the fetal position or hide

like a turtle in his shell, to cover his ears and try to take some deep breaths to calm himself. That if he was on the floor, not bothering or grabbing at people he would be safe and no one could hurt him. I guess what I am hoping for is to hear what others have done in this type of situation as well as how does the process work when charging a person, do we get a ticket or some sort of paper work showing this, as of today have not received. I'm not sure what to do here. Seems like they are violating is IEP. I'm not sure

what legal process you can go through to make sure his rights aren't violated.

This sounds so much like my son. I have no doubt that he has a sensory

processing disorder as well along with borderline aspergers. He was suspended

from school for 3 days because he kicked and spit at the teacher. SHe was trying

to escort him to his seat after he was smashing another student's fingers and

toes and the situation escalated from there. It sounds like he was in sensory

overload and lost it when the teacher tried to escort him back to his seat. He

is in kinder without a diagnoses. It will probably take months before we can

even get a diagnoses. I need to see what my insurance will cover and get him

somewhere so that he can have an IEP. Because at the moment they are not

recognizing him having any issues and not dealing with the sensory melt downs

appropriately. I think we have along road ahead.

Thank you for your concern and caring it helps when others can give words of encouragement. My son will not talk about what happened before or during him being restrained. I am not sure why, I am sure it is difficult to remember due to the what must go on in his brain when all heck brakes loose. All my son can say is Mom I cant get what happened out of my mind. :( I know I am also traumatized, I mean my son went through a lot with what the SRO did to him, but my witnessing what the policeman had to say, so I can not even imagine what my son is going through.

I have printed out your email so that I am able to follow your procedure. I am grateful you gave me your phone number I have added it to my Phone book of support people. Thank you for your help. I am sure you will hear from me in the next few weeks, this is not going to be easy. I have consulted with one attorney through a referral of an advocate I know, but will not know anything until this week if he will take on my case for free, as money for me a big issue, can not work and my son is on Soc. Sec. The school has made employment while the son is at school impossible due to phone calls and suspensions. Who would let me keep a job with having to be on the phone with personal calls from the school and leaving to pick my son up all the time. Just a question on finding a lawyer, did you just call civil rights and education lawyers from the phone book or what was you procedure in finding one pro bono? Originally there was a IEP review meeting set up for Thur Sept 30th, and yesterday the mail man brought me a registered letter that was from the school and now the IEP review meeting has turned into a Manifestation review. I know that my ARC advocate will attend with me, but now sure about the lawyer as I am not sure if he will take my case for free.

I believe it isusually called nonvoliolent crisis intervention and their methods make my son more aggressive and he is always hurt in the process. He knows how to get out of most holds and will severly injure himself or someone else if they try to hold him this way when he is upset- giving himspace and allowing him to calm down is usually the only way to handle him. I woudl stipulate this done before any other thing is tried in all circumstances. I wen tot the superintendent with the injuries my son had and they switched his school to a place that could handle him better and had better trained staff. It has not been perfect but much better than our previous situation was.

This is awful! We had an SRO called on my son last year (he was 8 at the time). He did not get arrested but it was a huge thing. What a shame on these schools and sheriffs offices!!!!!!!!

CPI stands for Crisis Prevention Intervention....and it teaches us how to stand , block a punch, get out of a hairpull, or a choke hold...and it also teaches us how to restain a child w/out hurting them. Everything they teach you is to prevent a crisis....and it takes 8 hours. Every other year I have to take the 8 hour cours and every other year I have to take the 4 hour refresher course. The course also teaches us the signs of escalation and how to prevent it from becoming a crisis! It is mandatory in our school district for monitors, paras and teachers to take this course. Thankfully I have never had to use it.

I work as a para in a school and we are all required to be certified in CPI. In fact, I have to take my refresher course next week. The teacher should have called the asst. principal or principal and then had someone take her class out of the room and left your son there with a adult. They should have called you and waited for you to come. Calling the SRO only made the situation worse. If they had taken the children out of the room and let your son calm down...it would have ended differently. All they needed to do is let him calm down and moved any objects out of his way so he would not get hurt.

I am praying for you and your son! Will your son talk about what went on before his meltdown? Good thing you had your other son with you and your cell phone and voice recorder. Great thinking on your part.

Both you and your son should get into therapy ASAP ...especially your son. He needs it! Before it is too late...don't want any more problems such as PTSD! And, you too....go and talk about it...it will help!

You can have an officer called on a child of 8? That's scary. My son is 7 and can be aggressive (hit 1 child 2 times last year because the child wouldn't play his game, called it dumb). I can't imagine police being called at such a young age. What did your son do? Was it at school?

I know this was directed at me but I would like to add an answer.Yes at any age the Resource Officer can be called.The first time this happened to my son at age 9 was after an hour of having his face pressed into the cement outside by 2 teachers......by admission of school AND he decided to try to get away to find me for help. My son was 8 last year and was having extreme difficulties (lots of stuff happening that really set him off). They called the police on him 3 different times. One time the police actually cufffed him. There were never any charges filed.

My 13 yr. old son dx with aspergers and sensory processing disorder was restrained and arrested by the school recourse officer at his middle school on Thursday, and then I was told by the school resource officer that he would be charged with resisting arrest and disturbing the school environment. I did not receive any ticket or paper work as of yet to show these charges. The only info I was given from the SRO was that when the SRO arrived to the Sp Ed room, my child was laying on the floor with a microphone in his hand, not sure why a microphone is in the SP. Ed room and not sure why my son had a microphone, maybe he was stemming on what on this object I am not sure. The SRO then stated he asked my son to get up and he then put his hand on my son, and this point my son lost it due to being sensory defensive at this point, I am guessing my son was already in meltdown mode his reason for being on the floor and using the coping skill I taught him, in order to try and regulate himself. Yes they were called and I work 5 minutes from the school and come anytime called. I was not called! I didnt know about the incident until the next day when my son saw one of the officers in the grocery store and hit behind me. he told me that police man is mean momma. When I asked him why is that he told me he was going to take me to jail. I called the school and the police department to find out there was an actual police statement and everything. My son was pretty out of control and the behavoral anylist stated in the police report to the officers (there were 2 and they were called twice) that my child should be baker acted.

I was not informed and would have not known a thing if my son hadnt told me.I went to the police department and spoke to the sheriff and asked to speak to the officers. According to them they did not even know my son was disabled (he has autism, bi-p[olar and sensory intergration disorder). They said when they came in he was conbative and they thought he was being a brat (their words) and when he threated to hit them if they touched him they told him they would arrest him and take him to jail. He asked to call me and they told him he could call from jail. They did not feel he needed baker acted and he calmed and they left. The sheriff told me that if he would have laid a hand on the officer he would have been arrested for assaulting an officer and charged!!!!

I went to the school board too as if the school felt he was a danger to himself or others they should have informed me. What if he would have came home and killed himself or hurt his sister or us while we were sleeping??? It is insane the system that we have that is supposed to help these children when we cannot be with them is failing greatly!!!

Sorry so long but even months later it makes me very angry and hurt.

Here are some details about what has been happening.

1. There is an IEP, and BIP - I have been working on getting each one of these changed and I have had an IEE granted on the FBA. The school did an FBA back in Jan 2010, out come of School dist FBA we do not know what causes the behaviors and the behavior are unpredictable, this is why I asked for an IEE on the FBA. The person who is to do the IEE FBA had a difficult time accessing an observation at the end of the school yr. She has had issues getting into the school this year to observe my child not sure why at this point.

2. I have meet with the school resource officer on many occasions to discuss what I have done as a parent in the school and school dist. In order to get a differnt placement, IEP, BIP etc. As well as informed the officer of my child's Sensory processing disorder and how he can become sensory defensive.

3. The school has not tried to change the current BIP or call any meetings on what is not working for my child at this time. I Have asked for meetings to review current IEP and etc, on the joke of the BIP in place it is stated that: use of non-violent CPI methods to block and or will escort student to the office (using non violent CPI) and or will call for an administrator or SRO for assistance. The school or district administrator will determine the appropriate disciplinary course of action based on the severity of the aggression and will contact the parent with the decision. MY son was lying on the floor in the fetal position. I had just taught my child this coping skill this last week, we call it turtle mode, to just lay on the floor in either the fetal position or hide like a turtle in his shell, to cover his ears and try to take some deep breaths to calm himself. That if he was on the floor, not bothering or grabbing at people he would be safe and no one could hurt him.

I guess what I am hoping for is to hear what others have done in this type of situation as well as how does the process work when charging a person, do we get a ticket or some sort of paper work showing this, as of today have not received. Thank I look forward to hearing from members.
