It is unreal!! If you google chilren with disabilities that have been arrested it is scary. There are 6-7 year olds up on charges!

My 13 yr. old son dx with aspergers and sensory processing disorder was restrained and arrested by the school recourse officer at his middle school on Thursday, and then I was told by the school resource officer that he would be charged with resisting arrest and disturbing the school environment. I did not receive any ticket or paper work as of yet to show these charges. The only info I was given from the SRO was that when the SRO arrived to the Sp Ed room, my child was laying on the floor with a microphone in his hand, not sure why a microphone is in the SP. Ed room and not sure why my son had a microphone, maybe he was stemming on what on this object I am not sure. The SRO then stated he asked my son to get up and he then put his hand on my son, and this point my son lost it due to being sensory defensive at this point, I am guessing my son was already in meltdown mode his reason for being on the floor and using the coping skill I taught him, in

order to try and regulate himself. It did not get better from this point, not only did the restraint take place, my son had an injury to the cornea of his eye but he also received bruising on his wrists and upper arms and thighs.

Hi,I agree with Jan on this issue... I am still crying over this..Here is a big (((HUG))) for you and your son! This is just insane to me to treat a child that way...any child for that manner. Makes me so livid the way that school districts are set up and they are just not educated on handling children with AS. We have to get out there and rally to make sure that the Federal/State Dept. of Education are doing theirjobs to educate teachers on AS . The school districts have this assine attitude that it is easier for them to railroad a child into court and out of theirschool then to offer to help and work with them.

Get rid of the Trouble Maker attitude! Read your Laws and IDEA Laws...get an attorney and fight back for your child! Go to the media about this.. call the newspaper, TV stations and put the word out before it happens to another child! This is wrong...Your child is being punished b/c of something he cannot control...By law the school district cannot do this. He could suffer permanent damage to hissight b/c of this. God..this is just awful. If you do not understandthe IDEA Law then they have to provide someone who can explain it to you. They will alsohave to reimburse you with attorney fees. I would sue. They have literally created irreversible damage to your son! Emotionally, and Physically..I would find out where that SRO came from and why he used force on my child at

all! My daughter was put with an outside counselor (psychologist) at school. How convenient for them to have her readily available in house. We were given a choice to do this or go to court! I was charged and expected to pay $110 an hour for this BS. When presented with the bill I just politely said to the VP you were the one who suggested this and placed her with the counselor and by law you have to absorb the cost. I have not heard a word since. I pulled her out and said no more counseling. My daughters neuro-psychologist was angry over this and said this is not what she needed at this time.. this all happened during her eval. I was prepared to go to the media and an attorney if they had of taken me to court! I am

happy that my daughter lashes out at me rather than at school. She is 5'7" tall (12 y.o) and could do some major damage. TG I get the brunt of it! She is the perfect child at school ! (so far) I know I would come unglued and be arrested ... if any officer placed their hands on her and left a mark at all! Sorry for the rant ...I am just livid..Big HUGS! Thank you so much for the kind words.It is about the children and my son has been through so much at age 15 and if I can spare a few kids what he has been through all the negative misunderstandings can turn positive. 3 years ago this is the same thing that happened to us.

You will be getting a letter in the mail from the police department and it will have the instructions on what to do.

Here is what I did:

1. Documented all the statements thus far.....Resource Officer, teacher, my son, etc....this included before, during and after incident

2. I got his primary doctor to write a 1 page summary letter of all his diagnoses and also got his other psych testing papers together and brought them to the juvenile intake meeting.

3. I call for an immediate IEP meeting......IEP and BIP were not being followed....(this is where I changed placement - see item #3). He was not going back - SAFETY was number #1 and I was serious about it.

4. I toured all the private schools as well as the public schools that serviced children like my son.....Aspie with food allergies and ADHD

Documentation is key - from the injures your son has to the statements of all involved parties......also call your local Special Needs lawyer and see if they happen to be taking cases for free - I have used an attorney 1 time like this.......amazing what cases they will take on. Or call the local University to see if Law Students need some experience.

She has had issues getting into the school this year to observe my child not sure why at this point. 2. I have meet with the school resource officer on many occasions to discuss what I have done as a parent in the school and school

dist. In order to get a differnt placement, IEP, BIP etc. As well as informed the officer of my child's Sensory processing disorder and how he can become sensory defensive. 3. The school has not tried to change the current BIP or call any meetings on what is not working for my child at this time. I Have asked for meetings to review current IEP and etc, on the joke of the BIP in place it is stated that: use of non-violent CPI methods to block and or will escort student to the office (using non violent CPI) and or will call for an administrator or SRO for assistance. The school or district administrator will determine the appropriate disciplinary course of action based on the severity of the aggression and will contact the parent with the decision. MY son was lying on the floor in the fetal position. I had just taught my child this coping skill this last week, we call it turtle mode, to just lay on the floor in either the fetal position or hide

like a turtle in his shell, to cover his ears and try to take some deep breaths to calm himself. That if he was on the floor, not bothering or grabbing at people he would be safe and no one could hurt him. I guess what I am hoping for is to hear what others have done in this type of situation as well as how does the process work when charging a person, do we get a ticket or some sort of paper work showing this, as of today have not received. I would rewrite the BP right away. You know your child and I am sure you can come up with a simple plan that will cover things until the FBA is completed. For instance, make a list of things that will bother him and what he looks like when he is starting to get upset. If you aren't sure how this looks in the school setting, go to the school and observe yourself.

Then write down how you want these issues handled. If he does well in turtle mode, then put that on there - that A) the teacher or aide should suggest he do just that when they note he is becoming anxious or upset. And B) if he appears to be doing that on his own, they should encourage him to do it and leave him alone to do that until he can calm down. I would list the things you want them to do in order of importance. And I would include "Call parent" well before they even get to a point where they would be calling police. Then get a meeting and give copies to everyone and put them on notice that this is the new BP pending the outcome of the FBA.

Write follow up letters up the food chain about the problems your behaviorist is having in accessing the school to do the FBA. Let them know the situation is severe and this needs to be done ASAP. Request their immediate cooperation.

If you can afford to, find a sped atty to help you sort this out. They can often expedite these situations and get the school staff to suddenly behave themselves. You can find a sped atty if you go to this website and search --> http://www.copaa.org/

If you can't afford an atty, at the least, contact your state parent information network and get an advocate involved. You want witnesses and help.

Finally, request a 1-1 aide for him asap. For his own protection as well as other student's protection, he obviously needs someone to help him directly. The thing is, the school will balk at providing a 1-1 and that might mean they help the behaviorist get things going quickly. But definitely put your request for a 1-1 in writing and state how serious this situation is.

I get angry when these people call the police on these kids. They just have no clue. BTW, my oldest ds did "the turtle" as well. He was one to shut down when he got upset and we always called it "the turtle" as well. He grew up loving turtles and still has a few. But he related a lot to them.

Dawn, you need to contact the Protection and Advocacy agency in your state. I am including a website with information to the agency in your state. Look to the right of the page, there is a drop down. Also, you may want to contact your local parent information network to get an advocate to help with the navigation of next steps. Pam :)

Wow a system like that is WELL NEEDED. I just got in touch with the legal center for people with disabilities. They listened when I told them my son's story, and said they had to do some checking and would call me back. I always get discouraged when I hear that. It seems that people without a lot of money need to rely on such agencies and then there really is nothing done about it. I mean I could be wrong in this situation, but the last lawyer I spoke with right after my son's incident he waited two days then sent me a letter saying he could not take on the case. So I hope something like a national hotline would help many people in the situation of restraint. I will keep in touch on this, I am very interested.

I am in VA and I just found info from VA PTI (PEATC) that states if police are involved the school is required to provide info to police prior to any criminal action.Hmmmm well I remember me taking care of that.Knowledge is power!Parents read your state's Special Ed Regulations.
