Definately need to call up some help - an advocate or a disability lawyer... someone. I'd want to know how long the probation is and in that time try to get the tools in place that would prevent this from reoccuring and for it to be recognized for what is it and dealt with accordingly. I would put in writing that you are objecting to the Behavior Intervention Plan that they proposed. (I guess they don't have one written down do they?). Request that a Functional Behavioral Assessment be done by a certified behaviorist before your son can return to school. You don't have to agree with their plans. I said 30 days just as an example as I think that is maximum that you could do. During that time they can determine a game plan, get the help you need all while he is in the safety and comfort of home. The amount of stress it could take off of shoulders is huge also so wouldn't worry about him as much. We chose to do this for our son who had been suspended then behavior started to escalate.We didn't know what the school was going to pull next. They were trying to send us a message and they were trying to push us out. My son was exhibiting so much stress and at school he would take it out on everybody. He's only 6 and we didn't want anything more on his record. This zero tolerance stuff is getting out of hand and the schools are using it every chance they can. We took a 2 week independant study and our heads and our hearts where clear and able to make some big decisions regarding his emotional well being and his education. ( ) ? So the school wants to have my 9 year old arrested, put into a orange jumpsuit and hauled to juvenile detention... All because his teacher would not get out of his face yelling over homework he had already done! He is aspergers.. He's not that broken, empty beaten down hull I used to pick up everyday in 3rd grade! So, I was happy! But if they won't recognize the disability guess I'll be back to looking for a place!
