I don't see where you have sustained damages as your son wasn't injured, but a decent case can be made for hostile situation. So you need proof. Get the principal to acknowledge and document the incident. Use this to either lawyer up or use the threat of it to get the school system to bend over backwards for you.Have you identified a spec ed advocate?
