Guest guest
Hi . Can you tell me how this " class action " lawsuit is going to work? I was always under the impression that there would be one law firm handling a class action lawsuit. Also, would this class action be just for homeowners or is it for employees to file against their employers, insurers, workman's comp, and disability vendors? Is the $50 refundable later on or is this just an administrative fee to get the ball rolling? I've just never heard of class action suit retainer fees. If an attorney takes a class action lawsuit, he usually takes on the responsibility of upfront expenses unless I have a mistaken view of this. Does the $50 assure us that our case will be taken? If it isn't, are we refunded? If a lawyer does take our case(s), will it be on contingency or will we be liable for other fees? Is the NTMC a 501c3 organization? I'd be happy to review the petition when it's ready, too. Thanks. Barth SBS: MY STORY: www.presenting.net/sbs/sbsstory.html
Guest guest
Hi , I am writing you back and sharing this info with group as the response is great and I want everyone to know the proceedure. We are intent on filing this classaction within the next few months. It will be a classaction against the insurors only at this time. We can name more than one company in the Petition as long as they all commit the same violations. Which of course they are. These actions are: failure to pay claims in a timely fashin failure to pay at all, forgery on any documents, destruction of any evidence, obstruction of justice, defamation by implecation, and consumer fraud. We are taking bids from attorneys and interviewing to see who the lucky firm will be.Ha! I am a paralegal with over 20 years experience in the courts in Texas. I was a court appointed investigator, criminal and civil for many years. I have seen it all. We need you to send a copy of your insurance policy, email a statement that you want to be joined as a party to the suit and petition. We need a list of medical bills associated with your case. We need any notes of conversations with your insurance co. A claim number or letter of filing. We need any denial of claim, a list of damages, monetary value. At a later date we will need any pictures, tangible evidence, etc. We will send a letter requesting that information at the time it is need to present to attorneys. We are only charging a $50.00 fee for retaining an attorney and legal secretary duties. It is terribly fair and reasonable for the victims but as a group will ensure our efforts in numbers. You can send the check or money order, to NTMC, P.O. Box 923, Ozark, Mo. 65721 please put in the corner of check for: CLASSACTION We are presently writing a Petition to Congress for victim rights in Toxic Mold Cases, legislation enactment, and to approach Congress in person. We hope to have HADD AND HOBB, AS WELL AS SOME OTHERS JOIN US IN THAT MEETING IN D.C. We ask that you join either the Coaltion or Foundation in order to be able to sign Petitions, legislation, and Bill enactments. Congress sees numbers and names after. Membership prices are at our website: www.geocities.com/marbme12/NTMC.html I will tell you now our membership is growing, our class action is growing, and we are a tough Coalition and Caring Foundation. Our slogan, STAMP OUT TOXIC MOLD, VENT MOLD ISSUES HERE! Direct all questions to Carroll-Bower, Pres. Founder, NTMC & NTMF at: marbme12@... Thanks, my heart goes out to you all. --- Barth <pbarth@...> wrote: > Hi . Can you tell me how this " class action " > lawsuit is going to > work?
