To tell a story one needs to present facts. Here are the emails in order they were written. You must remember that I emailed my Federal Mold Legislation to MS. sometime earlier than these communications so she knew who I was. I had asked her to give my legislation to Congressman Conyers to review. My beginning e-mail was about senior citizens in government housing living in mold.

I've deleted the e-mail address list so protect confidentiality.

I told them I would try and help.

Hello Everyone,

Congressman Conyers, is working steadily on a bill that add protection to homeowners nationwide. As you know by now, I am familiar first hand about what toxic mold can do to a family. Currently, I am working hard to come up with a bill draft that will not only pass the house but this time pass the senate as well. What I need is a letter campaign. As painful as it sounds, it will be necessary to get as many personal stories as possible with contact information, so that we can begin to put the fire behind the bill that will be needed.

I waited a day to reply. Before replying I was told by two people in my e-mail list that they had contacted Ms. . One was told by Ms. she was working with me and the other was told she didn't know me. Can't have it both ways.

Subject: Re: EFFECTIVE Mold legislation

I received your email about the mold legislation that Congressman Conyers has been working on for a year. Could you send me a copy of what has been accomplished in that year? Before anybody is willing to write in support of anything I think it only fair to know what we are being asked to support.

A while ago I sent you a copy of the mold legislation that I had put together. As everybody knows, this is based on California mold legislation that was passed. I only added areas that strengthen the bill, add penalties for those that are responsible for mold, added to those that must disclose. I have never received any communications from you or anybody from the Congressman's staff about this bill. Why?

There are perhaps millions of Americans that are suffering from the effects of mold in their homes, place of work, schools, nursing homes, hospitals and Government buildings. For some reason, many in Congress have avoided or skirted the issue. It is we, the citizens and voters, that telling the members of Congress that you MUST act!

To continue to refuse or delay in discussing this issue only allows more people to become ill. This is usually the tactic that is used by insurance companies and lawyers in their attempts to drag on or bury legal claims. Is this the same tactic that Congress has decided to use?

When dealing with the issue of mold we must also deal with how it is caused and how to stop and correct those causes. This is the same way that we have fought the anthrax epidemic. Investigations and analysis are used, as in treating illnesses, what caused the people to become ill or die from anthrax.

Mold can be just as serious and deadly as anthrax or e. coli. The tolerance level to mold must be ZERO just as it is for e. coli. If we get legislation that sets a zero tolerance for mold but fail to deal with the causes, we will have accomplished little.

Congress must decide, we citizens already have, that those that knowingly place families in danger from mold must be held accountable. This must be true of insurance companies, real estate companies that fail to acknowledge the presence of mold and local and state inspectors that knowingly allow the conditions to exist that will lead to mold.

Did Congress not do that on the issue of smoking. After smoking was determined to be harmful to ones health you also said the cigarette companies were liable for creating a dangerous product. The same must be true when government inspectors fail to enforce or obey the laws that are to protect us. Why should government be any less liable than the corporations that you regulate? Government is not above the law si it?

A few decades ago I worked in the Intelligence community in Washington so I have a first hand knowledge of how government "works". At times I helped to present Intelligence briefings to capitol Hill on issues of national Defense. I know that it is the staff members that usually write the legislation, do the research and provide the analysis for the members of Congress. Many yield more power than the officials we elect for they control what happens behind the scenes.

I would like to know what are Congressman Conyers thoughts on my legislation? If he thinks that improvements can be made I am more than willing to listen and work to get "EFFECTIVE" legislation passed. The key is effective and not something watered down that lobbyist will sign off on. Remember that our Government is of "We the People".

A final point is that when people are fighting against evil or an enemy we usually like to put a face to it. An example is our Nations fight against terrorism. President Bush placed the face of Bin Laden as the enemy. I have attached a photo of the enemy we are fighting.

Will the Congressman work with me? I am ready is he?

Mr. Moulton and Others,

In reply to your most recent e-mail message:

1) H.R. 3899 during the 105th Congress passed the house....and did not pass the U.S. Senate, since I am not employed by the senate I can't answer your question. Additionally, the member introducing HR 3899, was not re-elected in the 1998 campaign, and without a new sponsor to re-introduce the bill, the bill died.

2) SB 732 is a state bill not a federal bill.

3) Letters documenting individual cases are needed to substanstiate the need for legislation. It is necessary to paint congress a clear picture of the need to appropriate millions. Do you have a better way? In addition to seeking the support of consumer groups that can help lead the fight.

4) I obviously am not asking for support of a bill that has not yet been drafted. This bill will be structured around the needs of the documented cases that we foward to Congress.

5) Once the bill has been completed and drafted it will be accessible through the THOMAS web site.

Futhermore, decisions to either support the bill or otherwise a perfectly.

6) I would rather not be burdened by riduclous, accusations, about the lack of support by the U.S. House of Representatives, when in fact I have persuaded the ranking member of the House Judiciary Committee who is by the way a 38 year veteran member of congress to introduce federal legislation.

7) Mr. Conyers Bill will not have anything to do with the California State Legislation: SB732. Obviously, except that it will hopefully make it easier for states to adopt state legislation, by recognizing Mold as a problem nationally.

8) I suppose you could probably best answer the question why hasn't Congress supported previous Mold legislation efforts. If your most recent email message creates the status quo of how you treat people with concerted efforts to help well then you already know the answer to your question.

9) I will not be drafting legislation on behalf of Mr. Conyers that never makes it out of the house of reps. because of lack of organization, care and concern from the people who need it most.

10) I thank you for your interesting E-mail, and wish you well on your efforts and sincerely, hope that you will reciprocate.

This e-mail came from a friend on my email list. Notice the reply from Ms. .

Ken,

This is the response I got from Ms. regarding 2 messages I sent her.

One I sent last night after talking with and wondering if this

was a big competition thing with them "needing their name attached" to a

bill. I thought you'd be interested in this. Yesterday by phone she

mentioned knowing about a mold bill that you had drafted....now in this

message she says: "I am not aware of a current mold bill". Dont' know if

she's trying to say that there is not one "passed" or she doesn't know about

it at all. Something just doesn't seem right here. I know yours isn't

passed, but theirs isn't even drafted! Obviously she knows

something.....she used your e-mail contacts to send her message!

I am perfectly willing and capable of helping anyone in Congress or

otherwise to tackle this HUGE issue, but will not engage in back-stabbing

tactics if this is the game they're playing. How can she automatically say

that your bill will not work? It's very similar to the CA bill and that

seems to be doing okay. I, like you, now have a lot of contacts regarding

this issue (although maybe not to the same extent as you) that can be of

huge benefit in our overall goal....and I'm willing to use them with the

intent is legitimate and honest on all accounts. I'm so glad that I have

talked with you and , and investigated further before putting time,

energy and effort into helping this congressman's office. It's awful that

you think you can trust people that have even gone through personal

experience...and then have to start doubting....

I also received the letter you sent to her and copied to many of us. Great

letter! Can I can forward that on to others? I didn't know if that would

be okay or not and wanted your permission. I wasn't sure if you wanted your

government background out there for everyone. I would like to pass it on so

people can see what's taking place. I'll send it to my private contacts and

the group too. Let me know your thoughts.

E-mail from Ms. to my friend-

My reply to Ms. 10 points e-mail

To respond to a few of your points -

1) If the House passed HR 3899, why did not Congressman Conyers, or any other member, pick up the legislation and rework it to get passed?

2) I know SB 732 is a state bill because I wrote to Governor and petitioned him to sign it into law.

3) If the members of Congress are not already aware of the issue of molds, they should perhaps watch the evening news once in a while or read a newspaper. Did nobody from Congress read or watch the news stories about schools being infected with mold?

4/5) I know of nobody that will blindly support any form of bill that has not even be written. Give us a call when the bill is written.

6) I have been writing to many members of Congress, both political parties, for several years trying to get some form of national building code standards. It seems that the members are too busy helping everybody else but we citizens that have lost our life savings to the types of illegal, unsafe and unhealthy construction. Even when insurance companies make repairs, in many instances, the problems are not fixed properly and people get sicker.

While Mr. Conyers has been a member of Congress for 38 years, why can he not get some type of bill passed to help Americans that are getting ill from mold? How long did it take Congressman Conyers to vacate his office during the anthrax scare, perhaps a few minutes? we cannot walk away from our problems so easily. With seniority and leadership comes responsibility!

7) Most of us common citizens were raised that if something works, try not to fix it. If the California bill was able to get approved, why not begin there? Why reinvent the wheel. We don't need a Rolls Royce, a Chevrolet will do as a beginning.

8) The major answer Congress won't support many efforts that help the majority of Americans will hopefi=ully be answered in the just signed Campaign Finance Reform bill. While it is a beginning, more is still needed. Where most Americans come from, if you take money from somebody you "OWE" them something in return. Isn't that part of what Watergate was about?

9) We are the people who need the help the most. We, like you, have mold problems. Sadly the EPA, even after being told by President Bush to investigate my mold complaints, letter dated 9/11/2001, they have yet to do anything but duck phone calls. They say air quality is not their problem Perhaps we should get rid of them and find somebody that can and wants to protect us.

10) Have you after all this time bothered to read my Mold bill that I sent? Part of the Legislative process is being able to negotiate. To negotiate you must have a proposal on the table to be discussed. I DO BUT Congressman CONYERS DOESN'T! Is he afraid to put this on the table for discussions He can put his name on it if he needs to. But please, ask him to do something. If he still can't get a bill written after a year he needs to look elsewhere.

Attached is a photo of the Special Interest that I represent.

Ken Moulton

A final point and addition. Attached is a photo of my other "Special Interest".

In an addition to point 1 - Since 1776, members of our Nations Military have stopped to pick up the Regimental Standard or American Flag when someone carrying it has fallen. It is time for Congress to live by the same motto and Military Standard of "HONOR, DUTY AND COUNTRY". I have lived by that Standard since taking the oath some 34 years ago. My oath also includes FAMILY!

Ken Moulton

My special interests photos were of my family.

Ms. s reply -

Mr. Moulton,

I do consider your e-mails to be hostile, future e-mail messages from you will be blocked. Do not attempt to send any more messages. Do not attempt to contact me. Further harassment will result in our office contacting the Capitol Police, this is your only warning.

Another friend replies about Ms. s e-mails.

Dear Ken,

I was planning to write to you before receiving this e-mail from you. There is nothing you wrote that should have been construed as threatening or rude. I just talked a bit ago with and made the comment to her that what Pamelia wrote to you is "so Washington". At least that's the way it seems to me. You stated almost exactly the same thing, just worded differently.

Since I'm female, I can get away with saying she's having something much more terrible than a bad hair day. I have written nothing to her--and will not contact her. I suspect she has lost any support she might have received from XXXX. Any hostility that has been displayed has been from her, not you.

We stand behind you, your family, and your efforts to get effective mold legislation introduced and passed.

I guess I won't be getting a Christmas card from her this year.

Given her attitude, I would not want to receive a holiday greeting from her for any occasion. On the brighter side of things, perhaps it's better that she showed her true colors this early. We do not need a viper in our midst, and she certainly seems to qualify as one.

Another friends e-mail reply about Ms. s e-mails.

Ken I am still in shock from reading her e-mail. I have gone back and read all of them again and can't figure out what happened. I don't remember reading the e-mail about elderly families living is state housing that has mold. Is that what set her off? If you still have the e-mail about the elderly would you forward it to me?

Well, there you have it. Sometimes I might seem too ethical, moral or demanding of government officials, but I NEVER threaten! Remember, they are suppose to work for us!

Why have they refused to give me a copy of their legislation on mold? Did Ms. ever give Congressman Conyers my mold legislation as I asked her to? If she did, what are his thoughts? If she didn't, WHY NOT?

Ken Moulton
