Barnstable Town council October 5, 2000

Good evening.

My name is Ken Moulton and I live in Centerville with my family. Tonight, I come before you to speak about affordable and safe housing.

It seems that whenever you have a problem with dealing with important, legal, moral or ethical issues, the law and peoples safety is the first loser. If our town attorneys had a true understanding and appreciation of the law, they would have told you that part of what you propose is illegal and in violation of state laws.

The law I speak of is 780 CMR. CMR stands for the Code of Massachusetts Regulations and 780 deals with the state building regulations and standards.

The law, as defined under 780, is quite specific. Section 102.4 states that no community may create local codes in violation of the state law. In other words, the state law is final!

Of course we know from your own public records that you have been knowingly violating 780 CMR for over 25 years. You have allowed millions of dollars of illegal and unsafe construction throughout Barnstable. Some of that illegal construction has caused ceilings to rot with mold and mildew as demonstrated in this picture.

To the citizens here and those watching at home, did you see the recent 48 hours special on CBS about the effects that mold and mildew can have. They showed homes, such as ours, that had many building code problems. Water leaked through the roofs and formed mold and mildew. According to the medical and scientific community, mold such as this causes brain damage, respiratory problems, birth defects and death. Are you now ready to accept the liability for these medical issues that your town's corruption has caused?

The next picture demonstrates a fireplace where you knowingly allowed the fire flashing to be illegally installed. Of course the fireplace can't be used because you also illegally allowed the interior of it to be lined with wood.

The final picture shows how your illegal and corrupt acts have caused a home to shift and move off of its foundation. As the home moves, everything begins to collapse. If you don't believe me you can check on the effects of gravity and matter. It has been Scientific fact for about 500 years.

May I suggest that before you go forward and place more citizens of Barnstable in fear for their lives, as you have knowingly done to my family, that you give up your foolish and illegal plan to circumvent state law.

I will also place into the record a letter that I wrote on July 8, 1994. It was delivered to then state representative Ed Teague. He has been aware of your ongoing corruption since at least December 22, 1992. To this day he refuses to respond?

In closing, at future council meetings I will present public record documents that show that your corruption has also been protected by a few select members of the Barnstable police department, our district attorney, and our former state representative Mr. Klimm and our current state representative Mr. Atsalis.

As they say you can run but you can't hide from the truth especially when your own documents and statements show how corrupt this town really is!.
