Subject: Weekly's group takes credit for the Injustices of Arbitration

:

: Consumers and Consumer Groups recently fought back giving proponents of

: binding arbitration a bloody nose in Texas House Subcommittee hearings.

:

: See the attached article written by Texans for Lawsuit Reform (TLR)

: trying to put the blame on trial lawyers. In the article TLR takes

: credit for the defeat of Texas Senate bill SR 1706 filed by Van

: de Putte on behalf of consumers, with HomeOwners for Better Building, NO

: TRIAL LAWYERS, leading the effort in the last legislative session.

: Weekly of TLR carefully chooses the words in the attached article

: that the bill would have prevented arbitration in " employee contracts, "

: when actually the bill was specifically designed to prevent the abuses of

: pre-dispute arbitration clauses, a requirement in all homebuilder

: contracts such as the one found in Weekly Homes contract. The

: fact is TLR and homebuildres have effectively blocked all rights of

: consumers to file a lawsuit in the courts of Texas to avoid all liability

: for big business, especially homebuilders.

:

: For the past 5 years HomeOwners for Better Building has been searching

: for any homeowner who has won in Binding Arbitration. We have only found

: 2 in the entire country but none in Texas. The Texas Courts have

: routinely upheld Arbitrator's terrible decisions in favor of homebuilders

: even when the arbitrator had a conflict of interest. Even when the

: arbitrators' decision was blatantly contrary to law, the courts have

: said: " We may not reconsider the award on the basis of alleged errors of

: fact or law or an alleged misinterpretation of the contract by the

: arbitrator. "

:

: The Result: Builders are no longer being sued because homeowners can not

: get to court in Texas.

: We challenge TLR to come out and fight the real leaders of this war on

: arbitration - THE CONSUMER - not the Trial Lawyers. TLR was a no show at

: the hearings where consumers and consumer groups begged for help from the

: state.

:

: This is the legacy of Weekly and friends of TLR.

:

: Bill: SB 1706 - Van de Putte

: Relating to Arbitration

: Subjects:I0065 Civil Remedies & Liabilities

: S8683 MEDIATION, DISPUTE RESOLUTION, & ARBITRATION

:

: Killed by & Weekly!

: Janet Ahmad, President

: HomeOwners for Better Building

: San , TX
