PRESS RELEASE On June 10, 2002, the Massachusetts State Legislatures Joint Committee on Health held a hearing on a proposed bill, S2353. This bill is aimed at helping those that have been infected by Toxic Molds. Its goal is to stop the manifestation of Toxic Molds and some of the instances that create or allow it such as illegal, unhealthy and unsafe building across the Commonwealth and failures by insurance companies and local and state government to protect their clients and employees . The Legislation is based upon a Mold Bill enacted last year in California. The bill was redesigned to allow for stronger standards on mold. It adds strong penalties and accountability for any, including State Government Agencies and employees, that allow or knowingly create or allow an environment for Toxic Mold. It mandates tough disclosures for builders, inspectors, realtors, landlords and government in regards to their knowledge of Toxic Mold. The Legislation removes the issue of Sovereign Immunity from local and state government when illegal acts of their staff or employees have been a contributing factor to Toxic Mold. It is considered to be the toughest Legislation in the Nation to deal with the issues of Toxic Mold and accountability. As the writer of the Legislation stated, if you find how to clean up Toxic Mold but ignore the actions that cause it, you have accomplished nothing. Under current Massachusetts Laws, citizens have had their legal rights removed by the State in attempts to hold many of those whose acts have made mold their byproduct or allowed or contributed to the growth of mold. Another by-product of this form of diminished legal rights against home and property owners is the lack of insurance coverage. While banks and mortgage holders require loan holders to have insurance coverage, very few insurance companies nationwide will cover any claims or loses that are suffered due to illegal or unsafe construction. Should a home have to be torn down or burned down due to Toxic Mold infestation, there is little or no protection. Should anybody die or suffer injuries, there is little or no protection for the public. Any insurance companies that had allowed coverage in the past have now changed their policies to stop coverage. The public is left defenseless! The Committee was told that under the Constitution of the United States and Commonwealth of Massachusetts, Government is responsible for protecting the health and common good of citizens. The writers of the Legislation had e-mailed and faxed various State officials asking them to attend the hearing but none responded to the health needs of Massachusetts. The Joint Committee lists their total membership at 16 Senators and Representatives. Only three members were able to attend the hearing and hear the compelling testimony in support of the Legislation. A few people that appeared and rose in opposition to the Legislation did not speak and submitted written replies for the Committee. The writer of the Legislation was given a two and a half business day notice of the scheduled hearing. Many Massachusetts citizens were not able to attend the hearing due to the short notice. Some are state and local employees and teachers. Many parents whose children have come in contact with Toxic Mold at school could not make day care arrangements to attend. The Committee received letters supporting the Legislation from citizens from Massachusetts and across the Nation that have been infected with Toxic Mold This same Mold Legislation has been modified by its writer for use at the Federal level and in several other States. Over 70 United States Senators and Representative have been asked to sponsor the Federal Legislation. Replies are still pending from our National Leaders. Every member of the Massachusetts State Senate was asked to support the Legislation but only one, Senator O'Leary, came forward and replied by submitting the Bill.
