Calif on a case soon and would like to know if you want to be included in my visit...... ........ie inspections, depositions, sampling, conferences with atty and MD, etc. .................. Sept 24 or 25 or 26 or Sept. 27 looks good. The airfare is $265 to LAX or San Diego.....roundtrip with a 14 day advance. I am simply trying to save my clients money by splitting costs, not looking for more work. Dr. L. Lipsey Professor and Toxicologist University of North Florida U. of Florida Med. Ctr, Jax Poison Control Center Board CV--Toxicology And Environmental Health Assoc. Contract for Professional Services The undersigned , individually and on behalf of the firm of (collectively "we"), hereby retain Lipsey and Associates, Inc. ("Lipsey") for full and complete professional services on all cases wherein we forward the retainer defined below, except as limited in scope or span on our instruction letter to you. 1. We will pay to Lipsey upon execution of this contract a nonrefundable retainer and minimum fee of $500.00 together with an additional retainer (refundable if not expended) of $2,000.00. These retainers, the original or a copy of this signed Contract for Professional Services and a letter authorizing full (or limited) service we request are to be received by Lipsey prior to the initiation of any services. 2. We shall pay Lipsey a fee for services computed as follows: (I) Nontestimony time including but not limited to review of files; preparation for deposition or trial; research, field, office, research and and document production time; portal to portal travel and waiting time; all at a rate of $300.00 per hour; (ii) Deposition and trial testimony time including portal to portal travel and waiting time at a rate of $400.00 per hour; (iii) Reimbursement of all costs including but not limited to travel expenses, lab services, long distance telephone charges, copy charges, etc. 3. We will pay all bills submitted by Lipsey and Associates, Inc. for services as described above. We will also pay all fees and costs for depositions or appearances of Lipsey as an expert witness under subpoena or as otherwise required by opposing counsel if opposing counsel has not paid such fees and costs within ninety days after initial billing. We believe these fees are reasonable and understand that these rates shall be effective throughout the term of the contract. 4. We shall pay fees in full at ville, Duval County, Florida within thirty (30) days of the billing date. We shall pay the interest billed on unpaid fees at the rate of 1 1/2% per month past due after 30 days at the maximum rate allowed by law. All invoices will be paid in ville, Florida. We understand that Lipsey's findings may not be favorable to the position of our client. Nonetheless, we will be fully responsible for these fees and costs, notwithstanding the findings made by Lipsey or the outcome of the litigation or any failure of our client to pay us. Expenses consistent with the terms and conditions of this contract will be reimbursed at cost upon receipt of the invoice. 5. In the event it becomes necessary to send Lipsey original documents or original photographs, we assume the responsibility and expense of insuring these items. 6. At least one week's notice will be given concerning the taking of depositions and/or trial date. In the event any scheduled proceeding is to be postponed, canceled or settled, then at least three days notice must be given to Lipsey to effect a "no charge" postponement. Otherwise, we will pay a fee equal to four hours time to Lipsey. 7. We agree that this contract shall be enforced in Duval County, Florida and in the event Lipsey must retain an attorney to enforce this contract, we will pay Lipsey's attorneys fees and costs resulting from such action if Lipsey is the prevailing party. We agree to pay legal fees incurred by Lipsey or its President, Dr. L. Lipsey, as an consequence of the provision of services to us hereunder, including but not limited to quashing or objecting to unreasonable subpoenas and\or protecting rights of Lipsey or Dr. L. Lipsey. 8. We will advise Lipsey, in writing, of our desire for a written report of findings or opinions. 9. A copy of this contract executed by the undersigned and faxed to Lipsey shall be deemed to be an original for all purposes. 10. Payments shall be made to Lipsey & Associates, Inc. at 1400 Prudential Drive, Suite 7, ville, Florida 32207.
