The decision was made yesterday in the Bower, Lane case against Gordon Elliott and Oakridge Properties and others, in favor of summary Judgment for the Defense by Judge Heller after a month delay on ruling and trial had been set. The Plaintiff's are filing an Appeal in the Missouri Supreme Court showing that the Judge was Predjudiced by the defense and false documents filed by same. The Appeal will show that the Judge continually mentioned that Plaintiffs were representing themselves and needed an attorney, although Bower clearly showed the court that she had carried the case for two years to trial on her own with Brain Damage. Doesn't say much for the Defense Attorney does it? Plaintiffs file that Judge violated their civil rights to the 7th Amendment by not allowing the case to proceed to try set by him, and the right to represent themselves guaranteed by the Constitution, and a jury trial requested by Plaintiffs initially. The Judge did not even view the 248 page brief which included pictures of evidence and medical records, which substaniate claims of Plaintiffs before the pre-trial hearing. Furthermore, that Judge ignored evidence that showed contrary to the Defense. Suit is being filed in Federal Court against several parties for Obstruction of Justice, Destruction of the evidence.
