This is easy to get as I am in the process of gathering ALL of mine for the past 20 years. Some have a fee. must ot as much as they charge an atty. I have read about one lady on our group, can'te rmember her name, Diane?- She was going to have her saline implant removed of 20+yrs; come to find out they were silicone instead of saline. Hopefully you had an MRI before your explant to confirm yours. I would send the doctor & hospital a letter requesting they that send you all copies, including pathology reports & hospital, anesth. reports; In the letter mention if there is a fee to contact yo. OR if you live in the same city, go to th hospital personally & they WILL give them to you. I did this & there was no fee at the hospital. If it wasn't for the support groups I would have never known to do this. I learned so much by looking thru my records. I guess these doctors thought I'd never see this stuff when they wrote it. Guest guest Posted July 1, 2002 Report Share Posted July 1, 2002 Yes to answer your question you have every right to get a copy of your surgery report, quite frankly I am totally amazed and sickened to think that they can do things like this, it just blows me away everytime I hear another horror story like this and makes me so so angry for the women who like you, have been taken advantage of and lied to. It must be kept as part of your chart in the doc's office. However, some places may only keep records for 7 yrs, while others keep them 10 yrs then destroy them. My experience is that most places keep records for 10 yrs, then destroy them. I would submit a written request (as you will be required to do that anyway)and tell them that you are requesting your entire med record (or just what you want). If all you want is the op report, specifically request the op report in its entirety. If you are still in the same town as the ps, then I would show up at their office and tell them you want the op report. Have your written request ready. There is a possibility that the chart may be stored in a warehouse, so they don't have easy access to it. But it's always good to try to get the material you want in person in conjunction with your written request. Also, if the ps says he doesn't have your records anymore, you might try the surgery center you had the explant done at. They may still have your records and may be able to provide it to you. As for the capsule/implant looking " clean " I would have to wonder. When stuff is sent to the path dept, the path dept usually puts the material in formalin, which will effectively destroy any bacteria or other growth on or in the implant. That is why Pierre Blais states that you need to take possession of the implants as soon as you are waking up in the PACU (recovery room). Plus the fact that you had a written draft of your wishes which was signed by your attorney violates a document. If you provided a copy of this document to your ps prior to surgery, then there is absolutely NO reason you should not have been in possession of those implants when you woke up. Anything that goes to pathology will ultimately have any bacterial or fungal growth destroyed due to the formalin they are placed in. My next question is did you ever question your ps as to why he sent the implants to path instead of giving them to you directly? And did your lawyer ever question this? Did you ever pursue this issue any further? I would also ask if you can get your implanting data--i.e., brand, lot #, type of implant used. This will identify whether they were silicone or saline. If there is any question, you can call the company and ask them what type of implant this (your) lot # is. One of my doctors once told me that they are taught to think the worse of their patients, not the best. Especially when it comes to patients complaining of pain & needing pain meds. Most of them will not try very hard to find the cause of the pain and just Rx pain meds. Then when the patient keeps complaining they still have pain, they label them drug seekers. Very few will go the extra mile to help us. And that includes women who never even had BI. I also heard that doctors least favorite patients are single women.
