Discrimination and violation of rights of a +ve couple by a private hospital in Delhi

Dear Forum,

Last month during a " Home Visit " I meet a newly HIV positive diagnosed couple.

In this case, according to the story of the couple- Is a story of breach of

confidentiality, discrimination, stigma, fear and panic

They ware charged Rs/ 450. for their HIV testing. There was no counselling

facility.

The Hospital which did the test did not follow the guidelines of NACP-3. They

did not get the benefit of BPL Card Holder.

As a result of the HIV status the RG Stone Hospital (Pvt.Ltd)the employer of the

couple dismissed both of them from their job, without any notice.

The behaviour of the owner of the Hospital, the Doctors and other staff of this

private hospital- RG Stone Hospital (Pvt. Ltd) is inhuman and discriminative.

Askok (Name Change) 30yr. H/O Asha (Name Change) 25yr. R/O Rohini Delhi. Both

are HIV+ and BPL Family.

Both are working in RG Stone Hospital (Pvt. Ltd) (Deepali Chowk) Rohini Delhi

from last 12 yrs. Ashok is working there as a liftmen & wife as a care worker.

Ashok worked there on different profiles (as a care worker, Security guard,

Driver) in the last 12 years.

1) In the month of January 2009 Ashok admitted for some opportunistic infections

(OI's) treated at RG Stone Hospital. There he founds HIV positive. After

diagnose HIV+ the Hospital Doctors are advise/refer him to ART Ambedkar Hospital

(Rohini Delhi)

2) Both husband wife go for HIV test in ICTC Ambedkar Hospital and there Ashok

and her wife again founds HIV+, then both are registered in ART Clinic Ambedkar

Hospital.

Both of their CD-4 counts was done which was quiet good. They improved from

their shock and relaxed after ART Clinic Counselling and OI's treatment

diagnosed by Dr.Aizaz (Medical officer ART)

3) In the month of March 2009 Ashok and his Wife come back to their job at RG

Stone Hospital(Pvt. Ltd). However, the Doctors and the administrative staff's

behaviour was totally changed. They were informed that they are dismissed from

their job without any prior notice, as they are suffering from HIV positive.

The couple and me requests to all Senior Doctors and administrative officers how

they can survive their livelihood without job? I told the authorities that they

are living on a rented place and does not have any family/relatives support in

Delhi.

Unfortunately, the RG Stone Hospital (Pvt. Ltd) authorities did not consider

their request and ordered them to leave the job with immediate effect and no

other benefits were released by hospital authorities.

Further at my visit at hospital I found that the RG Stone Hospital did not

follow the guidelines of NACP-3. At RG Stone Hospital (Ltd) Even the staffs

working at this hospital doesn’t have any basic ABC knowledge of HIV & AIDS.

The behaviour of the owner of Hospital, the doctors, and other staff of this

hospital is inhuman and discriminative.

I request you all- as on behalf of the -sufferers- kindly take strict action in

this regard and help them as soon as possible so that they can live their

livelihood normally.

I humbly request  NACO, DSACS,ILO, HEALTH MINISTERS (DELHI & CENTRAL GOVT) and

all concern authorities please consider this as a serious issue.
