Guest guest Posted May 26, 2010 Report Share Posted May 26, 2010 Wow, it is so late in the school year. I would hope that they can be flexible enough to work with you. I think it depends on what State you are in and what final grades he is missing. We have had a terrible time with our schools and I started out thanking them and really believing everything they said. It turned us in directions that we should never had to go down and has damaged my children's ability to get through school. Hopefully your son was doing okay for most of the year so that you can use that as the starting point. There is a good article on CALYME about education that you may want to look at where it tells some of the problems students have. Their is no right and wrong here and unless your school system has had a number of students with this disease they sure don't have a plan. You need to make sure they hear you on every issue that relates to getting him through this year, and let them know that you may need services, (homebound or a 504) for next year and you want to make sure before the end of this year what requirements they have for that. Anyway if the tell you something that you disagree with, ask them to please send that info in a letter explaining why they can not do this or that. They have to know from the get go that you are serious about making sure everything goes well and that there are no misunderstandings. This late in the year they should be able to let him study with you and take whatever assessments are necessary and be done with it. If they refuse ask them how they plan to grade him if he can not complete all the work the class is doing. In a nice way explain how unacceptable this is when your child did not plan this and it is out of his control. Be nice but do not walk out of the room with them promising anything unless you get it in writing. Our problems began when they promised us homebound if things deteriorated and 3 weeks later when we asked for it they refused and said it was too late in the school year. Our time frame was late March early April, and we did not know what to do because I could not get her to school. They let her walk away without any support. I found out later that in our school system, Homebound can be given up until the beginning of the last week of school. Had we had it a lot of other things would have played out better. Let them know that summer school really should not be an option because you can not predict how the medications will be affecting him and you want to finish this year so that he is in a better place to start next year. He should not have to redo the grade because of missing the end. Maybe if the teachers could work with you on an individual basis it might work out better. I do not know how things have been all year, but if he has done okay and has been able until this last time, kept up, then they really should help you out. Ask them what would they do with a child that had an infectious disease like (mono). How would they help that child? What about someone that has been in a serious accident and has been hospitalized. Your child is having some of the same problems where it is just not possible for him to do every single piece of work so they should be able to adapt. Good Luck, I hate these types of meetings where you need help and they can be nice or not. Just make sure that they explain why in writing if they refuse to help. Sorry this is so disjointed. I wanted to say something because your meeting is tomorrow but I have to get my kids in bed (the well one) for school tomorrow. Your school may be wonderful and everything will be okay, I hope so. Guest guest Posted May 26, 2010 Report Share Posted May 26, 2010 OH my gosh I so feel for you - my girls go to two different school and it's been a nightmare this year. My one has to have all her homework done by June 20th or she fails - have to hire a tutor for $17.00/hr to help..........isn't that the cats meow....... I am praying for you - been there done that - my one daughter has picked up all of the virus's going around since November and has missed so much school this last half can even count any more..........is just going back half days.........why does this have to be so hard on us and them? Most days I get up in the morning and wonder where the candid camera is.......and then I realize this is really my life and then I go and cry in the bathroom............. Guest guest Posted May 26, 2010 Report Share Posted May 26, 2010 First, do not sign anything without taking it home to read it and digest what you read. Second, document all of his symptoms, how it affects his ability to attend school and/or complete the work at home, and then what accomodations can solve or help solve the problem. Third, do not request a 504, you always want to request an eval for an IEP, and then if you can't get your child qualified on an IEP and the only chance you have of receiving accomodations is a 504, you agree to that. A 504 is not legally binding and doesn't carry the weight that an IEP does. Though to be honest, it's too late in the year for either a 504 or an IEP. However, you can inform the school that you are requesting an eval to begin at the beginning of the coming school year. Most states have at least a 30 day time period for the school to complete the eval (New Mexico is 60 and there are some others that I know are 60 also). If by chance you are lucky enough to have be in a state that has a 30 day or less (and you have that many days left of school), you may be able to push enough to get the process done, stating that you want it in place on day 1 of the new 2010 - 2011 school year. (It's doubtful this will work, it may be worth a try if you have enough days of school left though.) Fourth, remember that you will need to educate the school personnel on your son's illness. They do not understand, and they don't have a lot of time to learn, you need to be concise with your information. A 1 page summary of ways the disease affects people is helpful, most especially if a majority of it is bullet-pointed. If it's straight and to the point, they are more likely to read it. At the end, or on the reverse side, list some web site links that have truthful Lyme info. Many teachers and administrators will search out more info and you want to insure that info is accurate (not all will, but there are many). Fifth, be confident in yourself and your son. Teachers and administrators do not know everything. We know our child best, we now how they work and what they are capable of. Your knowledge and experience with your child is every bit as important as a teachers training. Do not let yourself be intimidated. Question things that don't seem reasonable to you. If they tell you it's what the guidelines, policy or laws state, ask to see that particular law, policy, or guideline in writing. And then remember, that policy and guidelines are just that...... guidelines and policies. There is always " wiggle room " in policies and guidelines. Policies can be changed, amended, and taken on a case-by-case basis. Guidelines are guidelines, not set in stone. Have them put this in the IEP ( " Each teacher will undergo training related to the social, emotional, cognitive, and physical implications of chronic lyme disease... as facilitated by parent at no cost to district " . I will come over there and do it for free. I can speak from the perspective of a LL School Social Worker and private practice therapist. Others may consider doing the same with regard to 504s and IEPs if such is avail in your areas (check with local lyme task forces/LDA groups for this). Good luck Laina and let me know what you need. I had the guidance and the nurse watch under our skin but I wish I had a handout or something that explained how lyme can interfere w/ learning, create ADHD like symptoms, etc Do you have any type of handout like this? Ask for a 504 if you don't have that or request consideration for an iep if he needs the specialized instruction. You are a member of both teams. Don't give up! Guest guest Posted May 26, 2010 Report Share Posted May 26, 2010 This is simply not true about a 504 so please be cautious here. A 504 is absolutely legally binding and holds plenty of weight. The Office of Civil Liberties can come in and shut down an entire school and/or hold individuals personally liable for not abiding by the accommodations set forth within the plan.  IDEA makes sure of this.  It is often beneficial to have a 504 plan, particularly if a child does not qualify for an IEP based upon the qualifying conditions for special education regulations. Having a Lyme diagnosis may not qualify a child for SS if it " seems " not to be impacting their education and/or does not require specialized instruction. The 504 is to ensure that a student receives the needed accommodations based upon their particular disability.  Laina, the school dept has 60 days to complete evals, then 10 days to develop and implement an IEP.  If that is what your child needs, don't let another day go by. Document everything. Put everything in writing to the school. At the end, or on the reverse side, list some web site links that have truthful Lyme info. Many teachers and administrators will search out more info and you want to insure that info is accurate (not all will, but there are many). Fifth, be confident in yourself and your son. Teachers and administrators do not know everything. We know our child best, we now how they work and what they are capable of. Your knowledge and experience with your child is every bit as important as a teachers training. Do not let yourself be intimidated. Question things that don't seem reasonable to you. If they tell you it's what the guidelines, policy or laws state, ask to see that particular law, policy, or guideline in writing. And then remember, that policy and guidelines are just that...... guidelines and policies. There is always " wiggle room " in policies and guidelines. Guest guest Posted May 26, 2010 Report Share Posted May 26, 2010 Kim, It's true a 504 is legally binding, but often the school will balk at giving a 504 (reality) -- so many people have advised me to ask for an IEP and back down to a 504 for my daughters. In our case, the school gave my homebound daughter a tutor for the month of December -- she came twice, went on vacation and was completely lame in every way. The counselor just volunteered to me this week that my daughter is in a tricky position because if she were just at home all the time she would qualify for a tutor but because she has been at school for 4 weeks and 2 days this semester she does not qualify! I am sure this is not true and that I could really push it but the reality is that at this point I have no problem educating her myself at home (we do extensions and are basically anchored by the school assignments) without having to worry about being a legally certified homeschooling parent. Besides the fact that my daughter desperately wants to be in school any part of any day that she possibly can. Schools are not equipped for the chronically ill child. They just deal very badly with it in general, with exceptions. At least our school is being good about not prosecuting and persecuting us, and I'm very grateful for that. Anyway, just to say that asking for an IEP can be a negotiating point from which you negotiate o the less rigorous 504 plan (your child may just need to have flexible deadlines, for example). With the IEP, my daughter is actually getting all pass/fail grades this year, turning in the homework, and taking tests at home (or not at all, in the case of math). At this point, just teaching her the material is the goal. And the choir and art teachers have been absolutely amazing about my daughters, really kind and loving and appreciative. Goes a long way, let me tell you.
