SUMMARY OF SPECIFIC PROVISIONS : This bill would amend the following sections: * Section heading, subdivisions 2, 3, 5 and 6 of section 2164 of the public health law; * Paragraph (a) of subdivision 7 of section 2164 of the public health law; * The opening paragraph of subdivision 8-a of section 2164 of the public health law; and * Subdivision 1 of section 914 of the education law. JUSTIFICATION : Lyme disease was first discovered in 1975. Since then, the disease has increased dramatically and has become an important public health problem in some areas of the United States, especially in the Northeast. Lyme disease is a tick-transmitted multisystem infection that if left undiagnosed can disseminate through the body and cause a wide range of manifestations, including neurological, cardiac, musculoskeletal, and ophthalmologic problems. At this time, there is no definitive treatment protocol for all phases of the disease. The deer or bear tick, which normally feed on the white-footed mouse, the white-tailed deer, other mammals, and birds, is responsible for transmitting Lyme disease bacteria to humans in the Northeast. Ticks search for host animals from the tips of grasses and shrubs and transfer to animals or person that brush against vegetation. As they feed, their bodies gradually enlarge. It is believed that ticks transmit Lyme disease to humans during the nymph stage, because nymphs are more likely to feed on a person and are rarely noticed because of their small size. Lyme disease is often difficult to diagnose because its symptoms mimic those of many other diseases. The fever, muscle aches, and fatigue of Lyme disease can easily be mistaken for viral infections, such as influenza or infectious mononucleosis. Vaccinating children against Lyme disease would help stem a public health crisis. PRIOR LEGISLATIVE HISTORY : New bill. FISCAL IMPLICATIONS : None. EFFECTIVE DATE : This act shall take effect immediately and shall apply only to children born on or after: a. January 1, 1998, beginning with their enrollment in any public, private or parochial secondary school, and b.
