Â I know that in Maine the laws are clear about the schooling and the amount of hours that are required for students to be in school. Â I am sorry that you have to go through this. Â I don't think it would be legal there but then again who am I to say. Â The teachers should have known that your son would react poorly to the situation. Â I think it is more their fault than his. Â My son would have reacted the same way. Â He has hit kids on the head who are crying and screaming near him. Â I am sure he would also do it to adults if they were acting that way. Â It is not appropriate for any principal to yell at the kids. Â What does that do to help the situation? Â I can never understand why they would think that would help or change anything. Â I have found that with my children, I have three teenagers, that if I show strong emotion they are more inclined to to the behavior again. The school is offering him to be tutored at an alternate site which would be only 4 days a week from 9-noon. Meanwhile, we have requested out of district placement, however, it will not be in place until some time after he returns from the suspension. Are they legally within their right to not allow him to return to his original programming until we find an out of district school? Any help would be greatly appreciated! !!! I think if it was just another kid it wouldn't have been a big deal, but since it was the Principal it is. I am sorry this happened. My Daughter also cannot handle others being mad, sad, or crying, but she runs away or drops to the ground covering her ears. They are getting very strict these days when it comes to any kind of hitting and pushing. They consider it a sign of violence and often they will have a zero tolerance policy in place. Maybe it will be a blessing in the end. Maybe something will come of all of this and he will get a better placing for him where they will understand and be caring and loving. If they would just back off & understand he his autism and the noise issues, maybe the whole thing could have been avoided. You need to read your state education sites laws in special ed. They can suspend, but the placement issue is a question. Try this group. I think it's based in the east coast. They might know advocates & can give better advice. I believe they need a manifestation hearing & you need to help him & your district understand his behavior is due to his disability. The main question to ask, is how progress toward his goals and objectives will be implemented during this time. And I would also request a behavior assessment and have a BIP written into his IEP. If this behavior was the " manifestation of his disability " , it is not legal to be suspended because of it. What is required, is a BIP.
