If the school is instituting litigation against you, you need an attorney. There are pro bono/public advocacy clinics in many towns--some law schools also have clinics that will take certain types of cases and often offer sliding fee scales. Also, check with copaa.org--go to " find an attorney/advocate " for whatever state you are in. COPAA is a national organization of special ed attorneys--you should be able to find someone who can assist you. In a message dated 2/24/2010 3:56:24 P.M. We feel for you, but I think you need to contact your district parent liasion (if you have one) to guide you through the process of contesting this placement or hire a special ed advocate/attorney. http://wrightslaw.com/ has some info. You say District offers NPS (??) and then say District denies NPS. Not sure what you mean. The Honig Injunction is supposed to be filed when the school feels that keeping the child in that current placement while making placement decisions means someone is likely to get hurt. That, to me, means more than just 'sporadic behaviors'; they want to expel your child for some incident or incidents they feel put their staff/students or your child at risk of harm.
