The only people who are talking about it here really have no idea as to what constitutes credible evidence in medical practice, science or in a court of law. The problem would arise in hiring an attorney on a contingency basis. As for " legal burden of proof " that's totally different in civil cases as compared to criminal cases. Now days, it is much harder to file silly cases because lawyers just don't want to take a case that they won't win because it costs too much to produce a case- there is no way any person of normal means could afford to pay up front- the court costs are huge and the administrative costs are huge; they would have to put up at least 100,000 dollars for an attorney to take a case like that. Given that it would still cost more than that to try a case like that. I sued gelson a grocery store franchise for a slip and fall, which I won and the costs were huge just for my case. My attorney was a friend who took very little in fees from me, but still I knew how much money it took to try the case and I didn't even go to court. I slipped on some crushed olives and olive oil that some person had spilled. I fell on a tile floor. Not good. I completely shredded my lt ankle's ligaments and tendons; bruised the calcaneus bone and pulled the Achilles tendon. My mom fell in a parking lot on a broken part of concrete, and tore ligaments in her knee at a HUGE mall here and I never even thought of suing. She had permanent damage too, and was 72 years old. When I had my daughter, the doctor inserted the catheter for my epidural into my vein and not the Dura and I kept telling the nurse I was hallucinating, not feeling numb, and when the doctor went full force with the anesthesia I almost died, went into respiratory failure and he had to rip it out of my back and said, ³ OH SHIT!² Didn¹t sue then either. People told me I should have in both cases but I just guess I don¹t have what it takes to sue someone go figure, my name is Sue, too! So you have to sue them to pay your medical bills. My surgery cost over 20,000 dollars just for the surgery alone. My surgery was 6 hours long. The total costs for me were about 35,000. Dollars. And I have Blue + insurance PPO. That¹s wild my daughter had $320,000 worth of brain and spinal surgeries and our total out of pocket was less than $3,000. BUt my surgeon who is the best ankle surgeon on the west coast doesn't take insurance. So her fee- blue cross paid out less. She had Chiari I Malformation (brain stem encroaching into spinal chord) and 2 65 degree curves in her spine. She was 10. She is fused and has 4 rods screwed and hooked into her spinal column so she can¹t bend at all but she functions very normally and her only problem so far is she did dislocate her shoulder in gym (idiots made her get on the floor and crawl like a crab when she can¹t bend and they KNEW this) and she slipped and fell on shoulder. They knew she was not to do anything outside her realm of movement. WE had doctor¹s orders on file with the Nurse. But ‹ my daughter chose to do the activity. I am not saying she at fault. No one is. It happened. She wanted to be ³normal.² She wanted to do things other kids did. She was afraid to disobey the teacher. We have insurance. We will have co-pays, yes. I don¹t know how much depends on whether the surgeon we were told was the best to do this type of intra-shoulder surgery is in our network. If not insurance won¹t pay a dime of it.
