Guest guest Posted December 21, 2008 Report Share Posted December 21, 2008 Sue, The amount they laywer can receive is capped by law....the attorney will receive 25 percent or 5300.00 of the back benefit you receive (which ever is less) if you receive 80,000.00 in back bene's your attorney will receive 5300.....this is the maximum per federal law. For SSD they can only charge 10% of your award. And that percentage is from your check you get when you are approved because it is retroactive from the day you applied. Then they get ten percent of that check. Well it is supposed to be from the day you applied. I know some people get it from the day they applied and some don't. I didn't and I don'tknow why, or I'm not remembering the reason. I'm so sorry you didn't get approved, I know that can be depressing, especialy this time of the year......
