SSDI. and Stupid Receptionist

Well Gang, Becky picked me up 7:30 so we could get to dermatolist by 10:00 appt.

Got there and receptionist says they don't see patients on Fridays. She offered

an appt next week. I said no thx , I will go to walk-in clinic 20 mins from my

house.

Then I went to have a face to face with attorney about appealing the SSDI. I

thought that attnys don't get so much. She wants 25% of back pay or 6000.00. I

quess I heard somewhere that attnys only get 5% or so. What does the " or

6000.00 " mean? That if I don't get much , then I owe her ?!

Damn I hate doing business when i'm like this!

She can take 25% to a maximum of 6,000.00  The most she will ever get is 6,000.00  but that is provided you get a payout of 24,000.00.  She is bound by law not to take more than 25% of your back pay and there is a cap on that of 6K.  So if you got 50,000.00 in back pay, all she would get is 6K still.    Apparently they raised the cap.  It used to be 5K.

They can also bill you seperate for getting doctor's reports, phone calls Etc.

Just got a bill for $165.00 from my attorney for this and he gave me a big

break. This was for SSI but guessing it's the same deel. my back pay was a

little over 8 grand and he got a little over 2 grand plus the extra bill. My

back pay is spread over 3 easy payments of around 2 grand every six months, Will

take a year and a half to get all what they owe me so don't think you will have

any large anount of money at one time. It is better than the nothing I was

recieving the many years spent waiting though.my momthly pay is $675.00 and on

back pay they will give you less if you live with someone without paying rent

and deduct any money friends and familly gave you to live on so have a paper

drawn up saying all this was a loan and you have to pay it back.I lost several

thousand dollars on back pay by not knowing this..Good luck

Wow Butch.. things changed in a few years..  I did get a separate charge as well for under 200 bucks for records and such but it was taken out of my settlement check.  I was in court in mid-October 2007 and had my full check within 4 weeks for almost $18,000.00.  I guess they have changed things..  good to know.

ButchMore and more and more - can I see what an extremely bad plan you guys have for Disability. Why should it matter if you lived with someone or took loans etc. Isn't this fund built up from the years that you worked and put into the system??By the way, my disability here is only a little over that $675.00, so I had to get the $318.00 that my husband was paying me for the last 6 months. Now I have to do all the paper work in order to get it through the government because of his death.Oh well, such is life in an RV park now!!!Gloria
