Fresh is always better, of course. But powder will work in a pinch. The only immediate drawback is more with mechanics. Straining the powder mixture is more difficult than straining fresh peppers. More powder will "slip through" and get into the final tincture. This is not a bad thing, but some find it aesthetically unpleasing. Did that make any sense? I've been up since 3:30.
